Scope and Content

Resolutions are a formal expression of opinion or intention by which a municipality exercises its administrative authority. Resolutions are similar to ordinances (local laws which are valid only in the municipality unlike state laws with broader application) in form and style but are less formal and more limited in action.

The state municipal code empowers the governing body to exercise all administrative powers by resolution (Utah Code, 1953, Title 10, chapter 3, part 717 [2010]). Such general powers include establishing water and sewer rates, charges for garbage collection and fees charged for municipal services, establishing personnel policies and guidelines, and regulating the use and operation of municipal property. Punishment, fines, or forfeitures may not be imposed by resolution.

Resolutions take the same form and contain sections substantially similar to that of ordinances (Utah Code, 1953, Title 10, chapter 3, part 718 [1977]).
